These Terms of Service (“Terms”) govern your use of the DeadDivine website and any purchases made through deaddivine.com. By accessing our website, creating an order or otherwise using our services, you agree to these Terms. Please read them carefully before purchasing. Nothing within these Terms affects your statutory rights as a consumer.

1. ABOUT DEADDIVINE

DeadDivine is an independent clothing brand creating original apparel and accessories.

Throughout these Terms, “DeadDivine”, “we”, “us” and “our” refer to the business operating DeadDivine.

2. USING OUR WEBSITE

You may use the DeadDivine website for personal, lawful purposes.

You agree not to misuse the website, interfere with its operation, attempt to gain unauthorised access to our systems, use the website for fraudulent activity, or reproduce our content or designs without permission. We reserve the right to restrict access to our website where reasonably necessary to protect DeadDivine, our customers or our services.

3. PRODUCTS

We aim to describe and display our products as accurately as possible. However, colours and appearance may vary slightly depending on your screen, device, lighting and manufacturing process. Some DeadDivine products may feature intentionally distressed, washed, faded, oversized or otherwise individual finishes. Where relevant, these characteristics will be explained in the product description. Product availability is not guaranteed. We may discontinue or change products without notice, although this will not affect orders we have already accepted.

4. HAND-ILLUSTRATED DESIGNS

DeadDivine places human creativity at the centre of the brand. Unless otherwise stated, original DeadDivine artwork and graphics are created or commissioned through human creative processes. Our artwork, illustrations, graphics and other creative assets remain protected by applicable intellectual property laws. Purchasing a DeadDivine product does not transfer ownership of the artwork or grant permission to reproduce it commercially.

5. ORDERS

When you place an order, you are making an offer to purchase the selected products. You will receive an order confirmation using the email address supplied at checkout. We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, or we reasonably suspect fraudulent activity. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6. PRICES & PAYMENT

Prices are displayed on our website in the currency shown at checkout.
Any applicable delivery charges will be shown before you complete your purchase.

You are responsible for providing accurate billing and payment information. Payments are processed through the payment methods available through our website. DeadDivine does not directly store complete payment-card information where payment processing is handled by third-party payment providers.

7. DISCOUNT CODES & PROMOTIONS

From time to time, DeadDivine may offer discount codes, launch offers or other promotions.

Unless stated otherwise, promotional codes cannot be exchanged for cash, combined with another offer or applied retrospectively to an order that has already been placed. Promotions may have eligibility requirements, expiry dates, usage limits or a limited number of redemptions. For example, a promotion advertised as available to the first 11 qualifying customers will end once all 11 available redemptions have been used.

We may withdraw or amend a promotion where reasonably necessary,
but this will not affect qualifying orders already completed under that promotion.

8. SHIPPING & DELIVERY

Available shipping options, estimated delivery times and applicable costs are displayed during checkout or within our Shipping Policy. Delivery estimates are estimates rather than guaranteed arrival dates unless expressly stated otherwise. Please ensure that your delivery information is correct before submitting an order. Where goods are not delivered within the legally required timeframe or an agreed delivery period, your statutory rights remain unaffected.

UK online retailers generally must deliver goods within 30 days unless another timeframe has been agreed with the customer. GOV.UK

9. INTERNATIONAL ORDERS

International orders may be subject to customs duties, import taxes or other charges imposed by the destination country. Where these charges are not collected at checkout, they may be payable by the recipient. International customers are responsible for complying with applicable import requirements in their country.

10. CANCELLATIONS & RETURNS

We want you to love what you've summoned from DeadDivine. However, if you've changed your mind, you may have a legal right to cancel your purchase.

For most goods purchased online by UK consumers, you have 14 days from receiving your order to tell us that you wish to cancel. After notifying us, you generally have a further 14 days to return the goods. GOV.UK

Returned products should be handled only as much as reasonably necessary to inspect them, similar to what you could do in a physical shop. Please see our separate Returns & Refund Policy for instructions on making a return, applicable return costs and any exclusions.

Certain products, including some personalised/custom-made goods or sealed goods unsuitable for return for hygiene reasons once unsealed, may be exempt from change-of-mind cancellation rights where permitted by law. GOV.UK

11. FAULTY OR INCORRECT PRODUCTS

Products supplied by DeadDivine must be as described, of satisfactory quality and fit for purpose. These statutory rights cannot be excluded by our Terms. GOV.UK

If your product arrives faulty, damaged, incorrect or materially different from its description, please contact us at shop@deaddivine.com with your order details. Your rights concerning faulty goods are separate from our change-of-mind returns policy.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, all content appearing on deaddivine.com , including DeadDivine artwork, illustrations, clothing graphics, logos, branding, photography, text, graphics and website content belongs to DeadDivine or is used with appropriate permission.

You may not reproduce, distribute, modify, sell, manufacture products from, commercially exploit or otherwise use our intellectual property without prior written permission. This includes reproducing DeadDivine artwork on clothing, merchandise, prints or digital products.

Basically: admire the chaos. Wear the chaos. Don't steal the chaos.

13. USER CONTENT & REVIEWS

If you submit a review, photograph, comment or other content to DeadDivine, you remain responsible for the content you provide. You must not submit material that is unlawful, abusive, defamatory, misleading, infringing or violates another person's intellectual property or privacy rights. We may moderate or remove content where reasonably necessary. We will not use customer photographs for advertising or promotional purposes beyond permissions or rights you have granted to us.

14. THIRD-PARTY SERVICES

Our website may use or link to third-party services, including payment processors, delivery providers, social-media platforms and other services required to operate DeadDivine. Those third parties may have their own terms and privacy policies. DeadDivine is not responsible for independent third-party websites that we do not own or control, although this does not exclude any responsibility that we cannot legally exclude.

15. WEBSITE AVAILABILITY

We aim to keep deaddivine.com available and accurate, but we cannot guarantee uninterrupted access. We may temporarily suspend access for maintenance, technical problems, security reasons or circumstances outside our reasonable control.

16. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing in these Terms limits your statutory consumer rights or attempts to exclude liability that cannot legally be excluded, including applicable rights relating to faulty or misdescribed goods.

18. EMAIL & MARKETING

If you choose to join the DeadDivine mailing list, we may send you news, product launches, promotions and other marketing communications in accordance with applicable law. You can unsubscribe from marketing emails using the unsubscribe option included in our emails. Transactional communications relating to an order, such as confirmations, shipping updates or customer-service messages are separate from marketing communications.

19. CHANGES TO THESE TERMS

We may update these Terms occasionally to reflect changes to our business, website, services or legal obligations. The latest version will be published on this page with the date it was last updated. Changes will not retrospectively remove rights that have already arisen under an existing order.

20. GOVERNING LAW

These Terms and purchases made through DeadDivine are governed by the applicable laws of the United Kingdom, subject to any mandatory consumer protections that apply to you.

If you live elsewhere, you may also benefit from mandatory consumer protections in your country or region that cannot legally be excluded by these Terms.
